The probate court appoints a personal representative — usually called an executor (if named in the will) or administrator (if there is no will) — to manage the estate.
How a Probate Sale Works in California
Selling a home through probate in California involves several distinct steps that differ meaningfully from a standard real estate transaction. Here's the process:
1. Petition the court The executor or administrator files a petition with the probate court to open the estate and get authority to manage assets, including selling the property. |
2. Get a court-approved appraisal A probate referee — appointed by the state — appraises the property. The home cannot be listed below 90% of this appraised value. |

6. Close escrow Once the court confirms the sale, escrow closes and proceeds are distributed to heirs after debts and expenses are settled. |

What Is a Trust Sale?
A trust sale occurs when the deceased had a living trust — a legal arrangement in which property is transferred into a trust during the owner's lifetime, with named beneficiaries who receive the assets upon death. Trust sales bypass the probate court entirely, which is one of the primary reasons estate planning attorneys recommend them.
In a trust sale, the successor trustee — the person designated to manage the trust after the original trustee's death — has authority to sell the property without court approval. This makes the process significantly faster, more private, and less expensive than a probate sale.

The home's value in probate is set by a court-appointed referee — not Zillow
Families are sometimes surprised to learn that the value used to establish the probate sale minimum is determined by a state-appointed probate referee, not by an online estimate or even a standard appraisal. The property cannot be listed or sold below 90% of that referee's appraised value.
